There was a roll over crash in Dover today at the intersection of Springdale Ave and Hawthorne Ave. Hopefully everybody is ok. The first thing that stood out to me about this crash is that the car on it's side appears to have a corporate logo and information painted on the vehicle. The person driving this vehicle would have the protection of Massachusetts Workers Compensation, regardless of who caused the crash. Even if this driver caused it, they will still be protected by Workers Compensation.

That's because Workers Compensation does not rely on fault. If you lift a box and hurt your back at work; you're protected by workers compensation. If you aren't watching where you're going and you fall down the stairs at work; you're protected by workers compensation.


If the other vehicle caused the crash, the person driving the corporate vehicle would also have the potential to bring a Third-Party Claim against the driver of the other car.


If, however, the corporate vehicle caused the crash, the passengers in the other car could bring claims against the driver of the corporate car AND the corporation.
